1. Who we are, and what you are agreeing to
HouseListr is operated by HouseListr LLC ("HouseListr", "we", "us"). These Terms govern your use of the HouseListr platform: the dashboard, the hosted website we publish for you, and every related feature.
These Terms are between us and you, the real estate professional or brokerage who holds an account. They are not a contract with the consumers who visit your website. Section 11 explains how responsibility for those consumers is divided.
You accept these Terms by creating an account or by using the platform. If you are accepting on behalf of a brokerage, you confirm you are authorised to bind it.
You must be at least 18 years old to hold an account.
2. Definitions
- Your Content — everything you upload or write: listings, photographs, floor plans, copy, your logo, your team's biographies, and anything else you put into the platform.
- Consumer Data — personal information about the people who visit your website: leads, enquiries, booking and open-house RSVP details, and conversations with the AI assistant.
- Your Site — the public website we host and publish for you.
- AI Features — features that use a large language model, including the buyer-facing assistant, listing copy suggestions, and lead qualification. Section 9 covers these.
3. The service
We host Your Site, publish it on your domain, capture enquiries from it, and give you a dashboard to manage listings, leads, scheduling and marketing. Which features you get depends on your plan.
We improve the platform continuously and may change how features work. If we remove a feature you rely on, or materially reduce it, we will give you at least 30 days' notice by email. We will not silently downgrade what you are paying for.
4. Your account
Keep your login details secure and your account information accurate. You are responsible for what happens under your account and for your team members' use of it.
Tell us promptly at support@houselistr.com if you believe your account has been accessed without authorisation.
On authentication, plainly: we support email and password, Google sign-in, and optional multi-factor authentication using a time-based code from an authenticator app. If you turn multi-factor authentication on, you must complete that second step before accessing your dashboard. Some sensitive actions also require you to have authenticated recently and, when multi-factor authentication is enabled on your account, to have completed that second step for the current session.
5. Your content and your data belong to you
You own Your Content. You own your Consumer Data. You own your leads. Nothing in these Terms transfers ownership of any of it to us, at any point, including after you leave.
To run the service we need a limited licence: permission to host, store, reproduce, adapt for display, and publish Your Content, for the purpose of operating the platform and publishing Your Site. That licence exists so the product can function. It is not a licence to market ourselves with your material.
Specifically, we will not:
- use your name, logo, brand or Your Site in our marketing, case studies or portfolio without your prior written permission;
- sell, rent or share Your Content or your Consumer Data;
- use your Consumer Data to train machine learning models, ours or anyone else's (see Section 9);
- use your client lists, pricing or business strategy for any purpose other than providing the service to you.
We may produce aggregated, de-identified statistics across accounts to understand and improve the platform. Aggregated data will never identify you, your brokerage, your listings or any individual, and we will not publish benchmarks that could be traced back to a specific account.
6. Getting your data out, and leaving
You can leave, and take everything with you.
- Export. You may export your listings, media, site content and lead data. Export is self-service from your dashboard. Current status: the export feature is temporarily disabled while we fix a defect in the job pipeline. Until it is restored, email support@houselistr.com and we will produce your export manually. We will not use this gap as a reason to delay your departure.
- After termination. We retain your data for 30 days after your account closes so you can still request an export, then delete it. Ask us and we will delete it sooner.
- No exit fee, no hostage. We will not withhold your data, your content or your domain because an invoice is disputed or because you are leaving.
7. Custom domains and DNS
Your domain is yours. If you registered it, you keep the registration, the login and full control; we never take ownership of a domain you own.
You point DNS at our infrastructure, and we provision and renew TLS certificates for as long as your site is with us. When you leave, you simply repoint DNS. We will not delay, obstruct or condition that change, and we will keep Your Site serving until the end of your paid period so the switch does not create downtime.
If you ask us to register a domain on your behalf, we will register it in your name and transfer control to you on request.
8. AI features
We use AI in the product, and we would rather you knew exactly where.
Where AI is used. A buyer-facing assistant answers questions on your listing pages from your listing data; copy suggestions help you write listing titles, neighbourhood descriptions, biographies and messages; and lead qualification reads buyer conversations to extract stated facts and score enquiries.
Which provider. AI features are powered by Anthropic's Claude API. Content you and your site's visitors submit to those features is transmitted to Anthropic to generate a response.
Training. We do not use Your Content or Consumer Data to train AI models, and we do not grant our providers the right to do so.
Accuracy — read this. AI output can be wrong, incomplete or misleading. It is a draft, not a fact. You are responsible for reviewing anything AI-generated before you publish it, exactly as you would review copy from an assistant. We do not warrant that AI output is accurate, original, or free of third-party rights, and we do not publish AI-generated content to Your Site without your action.
Guardrails we do enforce. The buyer assistant answers only from your listing data and will not invent property details. Generated listing and neighbourhood copy is screened for language that could describe the people who live somewhere rather than the place itself (see Section 10). The assistant cannot book, send or transact on your behalf; every outbound action requires you to act.
Disclosure obligations. Some jurisdictions require you to tell consumers when they are interacting with AI or to complete bias assessments. Where such rules apply to your business, meeting them is your responsibility, and we will provide the information about our AI features that you need in order to do so.
9. Consumer data: who is responsible for what
This matters more in our product than in most, so we are being explicit.
For the consumers who use Your Site — you are the controller and we are the processor. You decide what to collect and why; we process it on your instructions to deliver the service. That means:
- You are responsible for publishing a privacy notice on Your Site, for obtaining any consent your jurisdiction requires, and for responding to consumer requests for access, correction or deletion.
- We will assist you in responding to those requests, will not use Consumer Data for our own purposes, and will not sell or share it.
For your own account information — we are the controller. Our Privacy Policy explains what we collect about you and why.
Current status, stated plainly: we do not yet provide a self-service tool for consumers to request deletion or a copy of their data, and there is not yet a dashboard control that lets you delete an individual lead record on request. If you receive a consumer request you must fulfil, contact support@houselistr.com and we will action it. Building this properly is a priority.
10. Your compliance obligations
You know your industry's rules better than we do, and you, not we, are the licensed professional. You are responsible for:
Licensing. Holding every licence, permit and registration your work requires, and displaying licence numbers and brokerage disclosures where your jurisdiction requires them.
Fair housing. Complying with the Fair Housing Act and every applicable state and local fair housing law. You must not publish advertising that indicates a preference, limitation or discrimination based on a protected characteristic, use targeting that acts as a proxy for one, or steer consumers toward or away from areas on that basis.
We screen AI-generated listing and neighbourhood copy for language that describes the people in an area rather than the area itself, and our AI prompts prohibit it. That screening is a safety net, not a compliance service. You remain responsible for everything published on Your Site, including copy a tool suggested. If we believe content on Your Site may violate fair housing law, we may remove or disable it and will tell you why.
MLS and IDX. Complying with your MLS agreements, IDX rules and syndication policies, including attribution, refresh requirements and removing listings when a feed ends.
Marketing communications. Obtaining and recording consent before sending marketing email or messages, honouring opt-outs promptly, and complying with CAN-SPAM, the TCPA and applicable state rules. Our marketing tools only send to contacts who explicitly opted in through your site or whom you marked as opted in, and we maintain a suppression list per account. Two current limitations you should know about: suppression is per-account, not platform-wide, so unsubscribing from you does not unsubscribe from another HouseListr customer; and we do not yet collect the physical postal address that CAN-SPAM requires in a marketing email footer. Do not use the broadcast feature for commercial marketing email until we have addressed both. We will tell you when we have.
Accuracy. Ensuring your listings, prices, availability and claims are accurate and that you hold the rights to every photograph, floor plan and text you upload.
11. Acceptable use
Do not use HouseListr to publish unlawful, deceptive, infringing or harassing content; upload data you have no right to; attempt to breach security, probe our systems, or access another customer's data; scrape or bulk-extract the platform; resell the service; or send unsolicited bulk messages.
Do not upload data subject to specialised regimes we are not built for, including protected health information, payment card data, or government identifiers.
12. Fees, renewal and cancellation
Fees, billing period and plan are set when you subscribe. We bill in advance.
Renewal. Subscriptions renew automatically for the same period unless you cancel. We will remind you by email before an annual renewal.
Cancellation. You may cancel at any time from your dashboard or by emailing support@houselistr.com. Cancellation takes effect at the end of your current paid period, and Your Site stays live until then. We do not charge an early termination fee and we do not accelerate the remaining term. You pay for the period you are in, and no more.
Refunds. Fees already paid are non-refundable except where required by law or where we have failed to provide the service. If we materially fail, tell us and we will make it right.
Price changes. We will give at least 30 days' notice by email before a price change takes effect. If you do not want to continue, cancel before it does.
Non-payment. If an invoice goes unpaid we will contact you before taking any action. We may suspend the service after 14 days of non-payment and may terminate after 30 days. Suspension does not delete your data, and Section 6 still applies.
13. Suspension and termination
We may suspend or terminate an account that materially breaches these Terms, where required by law, or where continued operation poses a genuine security risk. Except in an emergency, we will give you notice and a reasonable opportunity to fix the problem first.
You may terminate at any time under Section 12. On termination, Section 6 governs your data.
14. Service availability
We work to keep the platform available and monitored. We do not currently offer a contractual uptime commitment or service credits. We would rather say that than publish a number we have not committed to measuring. If and when we offer an SLA, it will be a separate, specific document, and we will tell you.
We may perform maintenance that briefly interrupts service, and will give notice where we reasonably can.
15. Accessibility
Websites offering goods and services are increasingly expected, and in many cases required, to be accessible to people with disabilities.
Our position, honestly stated: we design and build the platform and the site templates with accessibility in mind, and we target WCAG 2.2 Level AA as an engineering standard. We have not completed a third-party audit, we do not publish a conformance report, and we do not claim that Your Site is legally compliant. We do not sell an accessibility overlay widget, because overlays do not deliver compliance.
Accessibility also depends on choices you make: the images you upload and their alternative text, the colour and font settings you choose, the documents you link, and any third-party embed you add. Those are yours.
If you find an accessibility barrier in the platform, report it to support@houselistr.com and we will treat it as a defect.
16. Third-party services
The platform depends on third parties, including hosting, payments, email delivery, mapping and AI providers. Our Privacy Policy lists them. We choose them carefully and hold them to appropriate terms, but we do not control them, and we are not responsible for a third-party service you connect yourself.
17. Confidentiality
Each of us may learn confidential information about the other. Both of us will protect the other's confidential information with reasonable care and use it only for the purposes of this agreement. This obligation is mutual, and it survives termination.
18. Warranties and disclaimers
We provide the platform with reasonable skill and care. Beyond what these Terms state expressly, and to the extent the law allows, the platform is provided "as is", without implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
We do not promise business outcomes. We do not guarantee search rankings, traffic, lead volume, lead quality, or that any lead will transact.
19. Indemnification
You will indemnify us against third-party claims arising from Your Content, your use of the platform in breach of these Terms, or your breach of Section 10.
We will indemnify you against third-party claims alleging that the HouseListr platform itself, or a site template we supply, infringes that party's intellectual property rights, provided you tell us promptly and let us handle the defence. This does not extend to Your Content, to AI-generated output (Section 8), to material you supplied, or to your modifications.
20. Limitation of liability
Neither of us is liable for indirect, incidental, special or consequential damages, or for lost profits or lost business opportunity.
Our total aggregate liability arising out of or relating to these Terms is limited to the greater of (a) the fees you paid us in the 12 months before the event giving rise to the claim, or (b) $100.
Nothing here limits liability that cannot lawfully be limited, including for fraud, wilful misconduct, or death or personal injury caused by negligence.
21. Changes to these Terms
We may update these Terms. For material changes we will give at least 30 days' notice by email to your account address before they take effect, and we will keep prior versions available. We will not treat a change as accepted merely because it was posted somewhere.
If you do not accept a material change, cancel before it takes effect and we will refund the unused portion of your current period.
22. Disputes and governing law
These Terms are governed by the laws of New York, without regard to conflict of laws rules. The courts of New York County, New York have exclusive jurisdiction.
Before filing anything, please contact support@houselistr.com and give us 30 days to resolve it. In our experience nearly everything is resolvable that way.
23. General
Assignment. You may assign these Terms to a successor of your business on notice to us. We may assign to an affiliate or in connection with a merger or sale of assets.
Entire agreement. These Terms and the Privacy Policy are the entire agreement between us and supersede prior discussions.
Severability. If a provision is unenforceable, the rest stands.
No waiver. Not enforcing a right once does not waive it.
Survival. Sections 5, 6, 17, 18, 19, 20 and 22 survive termination.
